Stricter Rules for the Export of potentially Dangerous Goods

EU rules restricting the export of goods that can be misused for terrorist acts or human rights violations are getting an update.

How did we get here?

In 2009, the Council of the EU adopted Regulation (EC) No 428/2009 setting up a regime for the control of exports, transfer and transit of so-called dual-use items. These are goods and technologies that – besides legitimate civilian/industrial use – may also be misused for severe human rights violations, terrorist acts or the development of weapons of mass destruction. E.g. nuclear materials that are used for commercial nuclear energy may be weaponised. Rockets that are used for commercial satellites may be used as balistic missles. Technology moves fast and this law needs urgent updates to make it easier for exporters to stop potentially harmful exports to third nations. Especially, cyber-surveillance concerns and the addition of human rights provisions make an update necessary.

European Dual-use items have been used in the past by dictators and warlords to jail, silence or kill opposition forces and human rights activists. This updated law will ensure that European exporters do not support such actions anywhere in the world.

What's the content?

EU Commissioner for Trade Cecilia Malmström’proposal for a re-haul of the seven year old Regulation of Dual-Use Exports contains measures to cut red-tape and costs for European businesses as well as completely new measures:

 

 

The proposed system will allow for the effective management of authorised short-stays, increased automation at border-controls, and improved detection of document and identity fraud, according to the Commission.

The system will apply to all non-EU citizens who are admitted for a short stay in the Schengen area (maximum 90 days in any 180-day period).

What's happening with this legislation in the future?

The proposal is currently discussed in the Parliament's International Trade Committee, which presented a draft report in April 2017 and agreed on its position in January 2018 and among European Economic and Trade ministers and their lower level aides. Talks can start as soon as EU member states have agreed on their own negotiating position.
